I must admit that I'm a bit puzzled by this bit of the story in the first post -

But before that deal is done New Zealand needs approval from the US State Department which doesn't normally allow private companies to buy military equipment from foreign governments.


What regulation is there in the FARs or civil law that says that? If that was true, then why would it not apply to private citizens as well who have bought literally hundreds of Russian military aircraft direct from the governments who operated them.

ATSI bought Israeli A-4s many years ago. Hoss Pearson, former A-4 Blue Angel Boss was a princilpe in that company. He left them and is involved witha new company with a similar acronym name. The parent company is the company that also owns Sia Marchetti. The US State Dept. has to approve any importation of US built aircraft due to the International Arms Agreement. If they were Russian built no one would care. So far they've blocked the importation of the Skyhawks.

The sale to private companies and importation into the US is a bit of a red herring. The US will not allow the sale of US-supplied military equipment without their prior approval. It is a condition of sale when the equipment is initially exported. Where this equipment is even remotely current (the A4K's have an F-16 avionics suite) getting approval becomes even more difficult.
As the NZ Government's opinion on several US policies differs markedly from that of the current US administration, there is no desire on the part of the US State Department to approve any sales of NZ-owned, US-supplied equipment.
