Obviously there was some miscommunication. But the pilot is ultimately responsible for his actions. Knowing that there are a/c on the runway in front of you, and putting the hammer down without looking...?

All four of those pilots were very experinced and skilled. Somehow apparently Ladd just thought that Howard had cleared the runway. I don't see any logic in the legal result finding any of the blame on Howard, and/or EAA.
