Post subject:  fight over ww2 era tank heading to court

a company founded by microsoft co-founder paul allen has filed a law suit in california court over a ww2 german tank it says it paid $2.5 million for but never received it. the panzer IV was part of a fleet of of military vehicles amassed by collector jacques littlefield who kept them on his family estate above silicon valley in california. after his death his family turned over the collection to the collings foundation, which put some of them up for auction in july. the lawsuit filed by allen's company vulcan warbirds says it reached an agreement to buy the tank after the auction, but was later told it was a misunderstanding & collings didn't want to give up the tank. by then the money had already been wired to the auction company that was handling the auction. collings said the tank was never sold. the company then reached it's fund raising goal of $10 million from the auction to build a museum at it;s stow, ma. headquarters. the decision was made by collings board of trustees to keep it as it was felt the tank was the core to the collection. the auction company claims it returned the $$$ to vulcan but the suit by allen is against collings foundation & the auction house. there are only 5 panzer IV tanks in the u.s. & allen is suing for breach of contract.
